CVC 40519(b) Written Not Guilty Plea

After receiving my Notice of Traffic Violation from Redflex Traffic Systems on Tuesday for an automated red light traffic violation, I received my official "Notice of Bail" from the San Mateo County Courthouse yesterday. This is my green light to officially submit my not guilty plea by mail and request a Trial By Written Declaration as allowed by California Vehicle Code 40902.

I wrote up my Written Not Guilty Plea (CVC 40519b) as prescribed by TicketAssassin, walked down to the post office and mailed the letter, with a check for my $378.50 bail, via certified mail to the courthouse. TicketAssassin tells me the courthouse will reply to me with forms on how to submit my defense by mail. After I submit those forms to the court, the Menlo Park Police will be required to submit a written response and my case will be decided. If the Menlo Park Police fails to respond, my case will be dismissed and my bail will be refunded.

  • Does the written non-guilty plea require a specific form, or you just type the ticketassasin's sheet? I can't seem to find a standardized form in my county...

  • Ticket Assasin gives you the form if you register on their site.

    Did you just print out the Written Not Guilty Plea provided by Ticket Assasin and fill out those blanks according to your own case?

  • Well what happened? You never finished the story. Did you win, did it get thrown out, did you actually pay ticketassasin?

  • What we have overlooked is the fact that traffic and parking violations are not misdemeanors, but actually infractions. One does not need a "bailment" to merely assure a court their appearance. Its another scam and you need to object up front.
